2. Notice Period for Cancellations
To allow for adequate planning and resource allocation, Global Mars Translation Limited requires the following notice periods for cancellations:
- 48 Hours or More Before Project Start Date: Clients may cancel without any cancellation fee.
- 24 to 48 Hours Before Project Start Date: A cancellation fee of 50% of the total project cost will be applied.
- Less Than 24 Hours Before Project Start Date: Full service fees are payable due to the high likelihood of resource allocation at this stage.
Notices of cancellation must be submitted in writing to [contact email address]. Failure to provide written notice may affect eligibility for refunds.
3. Early Project Termination
If a client wishes to terminate a project after it has commenced, the following terms apply:
- Less than 25% Project Completion: A prorated fee, including 50% of the remaining balance, will be charged.
- 25% to 75% Project Completion: A prorated fee, including 75% of the remaining balance, will be charged.
- 75% or More Project Completion: The full project fee will be charged, as significant resources are likely to have been invested.
For ongoing contracts, such as long-term or recurring projects, specific cancellation terms may apply as outlined in individual agreements.
4. Refund Policy
Refunds are subject to the terms specified above and will be processed as follows:
- Full Refund Eligibility: If a cancellation is confirmed more than 48 hours before the project start date.
- Partial Refund Eligibility: Based on the prorated amount calculated from the service cancellation percentage outlined in Sections 2 and 3.
Refunds will be processed within 14 business days of cancellation confirmation, with funds returned via the original payment method unless another method is requested and agreed upon in writing. The client is responsible for any transaction fees related to the refund.
5. Force Majeure and Exceptional Circumstances
In cases where Global Mars Translation Limited cannot fulfill services due to uncontrollable events (e.g., natural disasters, political unrest, illness of key personnel), the client will receive:
- Full Refund: If the project cannot be rescheduled or completed.
- Rescheduling Option: To continue the project without additional fees if agreed upon by both parties.
Global Mars Translation Limited will communicate any such delays or cancellations as soon as possible and work to mitigate disruptions.
6. Dispute Resolution
In line with Kenyan business law, any disputes arising from this cancellation policy will be resolved through a structured process as follows:
- Step 1: Negotiation
- Both parties shall attempt to negotiate an amicable solution within 14 days of a dispute being raised.
- Step 2: Mediation
- If unresolved, the dispute will be referred to an independent mediator based in Nairobi, Kenya, agreed upon by both parties. Mediation costs shall be equally shared.
- Step 3: Legal Proceedings
- If mediation does not resolve the dispute, parties may proceed with legal action, with proceedings governed by the laws of Kenya.
7. Client Responsibilities and Obligations
To ensure service quality and compliance, clients must:
- Submit cancellation requests through the specified channels.
- Adhere to notice periods and terms as specified.
- Be responsible for any contractual or third-party commitments affected by the cancellation, as Global Mars Translation Limited will not be held liable for indirect costs incurred.
8. Changes to this Policy
Global Mars Translation Limited reserves the right to amend this Cancellation Policy at any time. Clients will be notified of any significant changes through email or website updates. Continued engagement after changes implies acceptance of the revised terms.
